1. Acceptance of Terms

By accessing or using AIvana, you agree to be legally bound by these Terms. If you do not agree, you must not use the application.

2. Description of Service

AIvana provides AI-powered image and video generation and modification services using third-party AI processing providers and cloud infrastructure.

3. Age Requirement (17+)

The Service is intended only for individuals aged 17 years or older. Use by minors is strictly prohibited.

4. App Store & Apple Terms

If downloaded via the Apple App Store, these Terms supplement Apple’s Licensed Application End User License Agreement. Apple is not responsible for the Service.

5. User Accounts

Access may be provided via guest access (Device ID) or Sign in with Apple.
You are responsible for all activity under your account.

6. User-Generated Content (UGC)

You retain ownership of content you create (“User Content”).
You are solely responsible for ensuring your content is lawful and appropriate.
We reserve the right to remove any User Content that violates these Terms.

7. Content Safety & Moderation (Zero Tolerance)

AIvana has zero tolerance for objectionable or abusive content.

We actively use automated content filtering (including prompt and output moderation) to prevent the generation or distribution of objectionable content.
Prohibited content includes (but is not limited to):
- Sexual or pornographic content
- Child exploitation or depiction of minors
- Violence, hate speech, harassment, or abuse
- Illegal or deceptive content (including deepfakes)

8. Reporting & Blocking Mechanisms

Users may report or flag any content they believe is objectionable directly within the app.
Users may block other users. Blocking immediately removes the reported content from the user’s view.
All reports automatically notify the developer for review.

9. Moderation Response Time

All reported content is reviewed within 24 hours.
If content violates these Terms, it is removed and the responsible account may be suspended or permanently banned.

10. Credits

Credits are virtual items with no monetary value.
Credits are non-transferable and non-refundable except where required by law.

11. Subscriptions

Subscriptions provide ad-free access and periodic credit allocations.
Billing and refunds are managed by the App Store.

12. Content Retention

Subscriber content is retained during an active subscription.
Non-subscriber content is retained for a maximum of 7 days.

13. Advertising

Ads are contextual and non-personalized. We do not use IDFA or device-level advertising identifiers.

14. AI Output Disclaimer

AI-generated content is for creative use only and may be inaccurate. You must not use AI output to deceive, harm, or impersonate others.

15. Termination

We may suspend or terminate accounts that violate these Terms. Unused credits are forfeited upon termination.

16. Limitation of Liability

The Service is provided “as is” without warranties. We are not liable for indirect or consequential damages.

17. Governing Law

These Terms are governed by the laws of Sweden. Courts of Stockholm have jurisdiction.
